Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and GiftFeels ("we", "us", "our") governing your use of giftfeels.in and every product, feature, template, and tool we offer (collectively, the "Service").

By accessing the Service, creating a gift, or opening a GiftFeels gift link, you confirm that you have read, understood, and agree to these Terms. If you don't agree, please don't use the Service.

These Terms incorporate by reference our Privacy & Data Policy, Refund Policy, and Cookie Policy.

You must be at least 13 years old (or the minimum digital consent age in your country — for example, 16 in some EU countries) to use GiftFeels. By using the Service, you represent that you meet this requirement.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Subject to these Terms, we grant you a limited, worldwide, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes and for any permitted business purposes in connection with paid features.

You may not:

• Resell, sublicense, or commercially redistribute the Service.
• Copy, modify, reverse-engineer, or create derivative works of our software, except to the extent expressly allowed by law.
• Use the Service to build a competing product or to train a machine-learning model.
• Circumvent or disable any security, rate-limiting, or usage controls.

The GiftFeels name, logo, templates, designs, code, and all other materials we create are owned by GiftFeels or our licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any rights in our intellectual property to you except for the limited license above.

You keep all ownership rights to the photos, text, and other material you upload or create on GiftFeels ("Your Content").

To operate the Service, you grant us a limited, worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, and make technical copies of Your Content solely for the purpose of providing the Service to you and to recipients you share with. This license ends when you delete your content or close your gift, subject to short retention periods described in our Privacy Policy.

We do not use Your Content to train AI or machine-learning models, to advertise products, or for any purpose other than delivering the Service.

You represent and warrant that:

• You own or have the right to upload Your Content and to grant the license above.
• Your Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party.
• Your Content does not violate any applicable law or these Terms.

You agree not to use GiftFeels to create, upload, or share:

• Content that is unlawful, fraudulent, defamatory, threatening, harassing, or that promotes violence or discrimination.
• Content that sexualizes or endangers minors in any way.
• Content that infringes another person's copyright, trademark, privacy, or publicity rights.
• Malware, phishing content, or anything designed to harm or mislead recipients.
• Automated scraping, load-testing, or reverse-engineering of the Service without written permission.
• Impersonation of any person or entity in a way intended to deceive.

We may remove any content and suspend or terminate access for any violation of this section, with or without notice.

GiftFeels uses unguessable private URLs to keep gifts confidential. Anyone with the URL can open the gift. You are responsible for who you share the link with and for keeping it secure. If you believe a link has been leaked or misused, email us immediately.

If you create an account (for paid features), you are responsible for safeguarding your credentials and for all activity under your account.

GiftFeels offers a free forever tier. Some optional features ("Paid Features") are available through one-time purchases or subscriptions. For Paid Features:

• You authorize us (and our payment processor) to charge your payment method for the amount displayed at checkout, including applicable taxes.
• Prices and available features may change. Price changes apply only to future purchases, not past transactions.
• You must provide accurate billing information. If a charge is declined, we may suspend the Paid Feature until payment is received.
• Subscriptions (if any) renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of your current billing period.

Refund eligibility, the request window, and the process are described in our Refund Policy, which forms part of these Terms.

The Service may link to or embed third-party services (such as WhatsApp share links, fonts, or payment processors). We are not responsible for the content, policies, or practices of any third-party service. Your use of them is governed by their own terms.

We respect intellectual property rights. If you believe content on GiftFeels infringes your copyright, please send a notice to info@giftfeels.in with the subject "DMCA Notice" containing:

1. A description of the copyrighted work you claim is infringed.
2. The URL where the infringing material is located.
3. Your contact information (name, email, address, phone).
4. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
5. A statement, made under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
6. Your physical or electronic signature.

We respond to valid notices and may remove allegedly infringing content. Repeat infringers may be banned.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFTFEELS, ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THAT PERIOD, OR (B) USD 100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the above limitations apply to the fullest extent permitted by law and nothing here affects your non-waivable statutory rights.

You agree to defend, indemnify, and hold harmless GiftFeels and its officers, employees, and affiliates from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) Your Content, or (c) your breach of these Terms.

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if we believe you have violated these Terms, created a legal or security risk, or if we are required to do so by law.

The sections on intellectual property, your content license, warranty disclaimer, limitation of liability, indemnification, governing law, and miscellaneous survive termination.

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Subject to applicable law and any mandatory consumer-protection rights you may have under your local law, the courts of competent jurisdiction in India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

If you are a consumer resident in the EU, UK, or another jurisdiction that grants you mandatory local-law rights, nothing in this section limits those rights.

Before filing a formal claim, you agree to first contact us at info@giftfeels.in and try to resolve the dispute in good faith for at least 30 days.

We may update these Terms as the Service evolves. When we make material changes, we'll update the "Last updated" date at the top of this page and, where appropriate, notify you (for example, via a banner or email). Your continued use of the Service after the effective date means you accept the updated Terms.

• Severability. If any provision of these Terms is held unenforceable, the remaining provisions stay in effect.
• No waiver. Our failure to enforce a right is not a waiver of that right.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Entire agreement. These Terms, together with the policies they reference, constitute the entire agreement between you and GiftFeels regarding the Service.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
